These Terms and Conditions govern the use of berneuco.com and all orders placed through it. By placing an order you accept these Terms in full. Please read them carefully and save a copy for your records.

2. The contract between us

Your order is an offer to buy from us. After you place an order you will receive an order acknowledgement by email; this confirms that we have received your order but does not conclude the contract. The contract is formed when we send you a dispatch confirmation email.

We may refuse or cancel an order if the item is unavailable, if the price or description contained an obvious error, if payment is declined, or if we reasonably suspect fraud. Where we cancel an order that has already been paid, we refund the full amount.

3. Products

We take care to describe and photograph our products accurately. Colours may nevertheless vary slightly depending on your screen. Sizes are indicative and may vary marginally between production batches. Any measurements provided are approximate.

4. Prices and payment

All prices are shown in euro (EUR) and include applicable VAT unless stated otherwise at checkout. Shipping costs, where applicable, are shown before you confirm your order.

Payment is taken at the time of purchase through our payment providers. We do not store your full card details. If a price error is discovered after your order, we will contact you before dispatch and you may confirm the corrected price or cancel free of charge.

5. Shipping and delivery

We ship internationally. Orders are processed within 1–2 business days of payment.

Estimated delivery time: 7–12 business days from the date your order is placed. You will receive a tracking link by email as soon as your parcel is dispatched, and you can follow it at any time on our Track your order page.

Delivery times are estimates and are not guaranteed. Delays caused by customs, carriers, extreme weather or incorrect delivery details provided by the customer are outside our control. Risk in the goods passes to you on delivery.

Customs duties or import taxes may apply to orders shipped outside the European Union and are the responsibility of the recipient.

6. Cancellation and returns

If you are a consumer in the EU or the UK you have a statutory right to withdraw from your purchase within 14 days of receiving the goods, without giving a reason.

In addition to your statutory rights, we offer a 30-day return window. Full details of how to return an item, the condition requirements and refund timescales are set out in our Returns & Refunds Policy, which forms part of these Terms.

7. Faulty or incorrect items

If an item arrives damaged, faulty or is not the item you ordered, contact us at berneuco@proton.me within 14 days of delivery with your order number and photographs. We will arrange a replacement or a full refund, including any delivery costs, at no charge to you. This does not affect your legal rights.

8. Acceptable use of the website

You agree not to use this website for any unlawful purpose, not to attempt to gain unauthorised access to it, and not to copy, reproduce or resell any part of it without our written permission.

9. Intellectual property

All content on this website — including text, product photographs, graphics, logos and the Berneu & Co name — is owned by BLACK WOLVES LTD or licensed to us, and is protected by intellectual property law.

10. Liability

We are responsible for foreseeable loss and damage caused by us. We are not liable for losses that were not foreseeable, or for loss of profit, business or opportunity. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be limited by law. Your statutory rights as a consumer are unaffected.

11. Privacy

We process personal data in accordance with our Privacy Policy.

12. Changes to these Terms

We may update these Terms from time to time. The version published on this page at the moment you place an order is the version that applies to that order.

13. Governing law and disputes

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer resident in the EU, you also benefit from the mandatory consumer protection provisions of your country of residence, and you may submit a dispute to the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
